A Nova Lei de Migração do Brasil, promulgada e em vigor desde 2017, proíbe a deportação coletiva e imediata de migrantes, pessoas deslocadas e solicitantes de refúgio, assegurando a estes o direito à defesa e a não-devolução (non-refoulement), princípio do direito internacional de refugiados. Com isso, a Lei de Migração brasileira segue os princípios garantidos e estipulados pelos principais acordos pactuados internacionalmente pelo Brasil nesta temática.

Diante da pandemia do novo coronavírus (COVID 19), o Brasil vem publicando uma série de portarias ministeriais (27 portarias até este momento) que restringem e punem com a “deportação imediata” a entrada de migrantes e pessoas deslocadas provenientes da Venezuela, inabilitando assim, o processo de solicitação do pedido de refúgio. A fronteira do Brasil com a Venezuela encontra-se fechada desde março de 2020, no entanto, outros pontos fronteiriços com os países vizinhos já foram reabertos por razões econômicas e comerciais, como é o caso do Paraguai.

Teria esse ato administrativo do Governo Federal, que restringe especificamente a entrada de venezuelanos para o país durante a pandemia, razões ideológicas? Justificar a publicação destas portarias, que infringem as normas nacionais do Brasil no quesito migração e refúgio, como uma “precaução sanitária” não é o bastante. A liberação do Governo Federal para a entrada de turistas, inclusive nas festas de ano novo, e investidores comerciais pelas vias áreas e terrestres no Brasil demonstra o grau de seletividade explícita e discriminatória aqui existente.

Não cabe outra saída, além das trilhas clandestinas ou “trouxas”, para aqueles que necessitam comprar alimentos, itens de higiene, remédios ou fugir de perseguições políticas vivenciadas na Venezuela. A situação humanitária e de risco enfrentada por estas pessoas é claramente mais agravada com o fechamento das fronteiras e com a punição arbitrária para a entrada não documentada em solo brasileiro. O governo brasileiro, por sua vez, segue indo de encontro com as suas leis nacionais, e contraria as leis internacionais para solicitantes de asilo por meio do controle discriminatório de fronteiras.
