Nesta sexta-feira, dia 10 de dezembro, a Declaração Universal dos Direitos Humanos (1948), documento composto por 30 artigos nos quais apresentam os direitos que todo ser humano possui ao nascer e ao longo da própria vida, celebra 73 anos de desempenho. A universalidade pretendida pela Declaração, inspirada nos conceitos de que todos os indivíduos são iguais, livres e aspiram a fraternidade, hoje parece não valer para todas as sociedades.
“Todo ser humano, vítima de perseguição, tem o direito de procurar e de gozar asilo em outros países”, dispõe o artigo 14 da Declaração. Ao longo dos anos, este princípio guiou diversas convenções e pactos globais, como a Convenção Relativa ao Estatuto dos Refugiados, no intuito de proteger e promover os direitos das pessoas que migram. Se para que todos os indivíduos gozem dos direitos humanos, não devem existir distinções de raça ou nacionalidade; por que as pessoas migrantes são vistas como inferiores e até mesmo como não dignas, diante dos cidadãos nacionais dos países desenvolvidos em que buscam refúgio?
O intelectual e sociólogo, Boaventura de Sousa Santos, destaca em seus estudos que há certas coletividades, que apesar de teoricamente serem sujeitos de direitos em jurisdições internacionais; na prática, são objetos de discursos dos direitos humanos. Como explicar ao mundo que entre 2014 e novembro de 2021, 22.940 pessoas morreram (OIM, 2021) no Mar Mediterrâneo na tentativa de se deslocarem em busca de asilo na União Europeia? E se nesta conta, ao invés das pessoas serem nacionais do continente africano e asiático, na verdade fossem cidadãos europeus ou norte-americanos? Estaríamos ainda em silêncio?
O direito à propriedade individual e ao livre comércio, que hoje são a base do nosso modelo de sociedade e economia, parecem provocar a inversão dos direitos humanos. Antes, os que eram vítimas de violações de direitos, passam a ser vistos como os agressores e invasores por tentarem fugir para protegerem o seu direito à vida. Por que não falamos também sobre os deveres que devemos ter como seres humanos? Que este 10 de dezembro nos faça refletir, construir novas lógicas humanas e quem sabe, responder com coerência algumas destas perguntas.
